Mississippi Newspaper Mentions “10 Minutes Too Late” Lawsuit

December 29th, 2009 · 2 Comments

Ballot Access News:

The December 28 issue of the Biloxi, Mississippi, Sun Herald, has this story about Brian Moore’s ongoing lawsuit to settle the exact deadline for candidates to file presidential elector paperwork to be on the ballot. The lawsuit is more than a year old, and is far from being settled. This is apparently the first time that any newspaper in Mississippi has mentioned the case.

” Heard the true story about the guy who wanted on the presidential ballot in Mississippi?

He sends his qualifying papers by taxi to the Mississippi secretary of state’s office. The cab driver arrives at 5 p.m. on the day qualifying is to end. The office is closed. The cabbie leaves the papers on the doorstep.”

Not exactly. The cabbie called ahead and was told they would wait a few extra minutes for him. They were still inside but locked the door when he got there.

Actually part of this was my fault, because I went by (wrong) memory and thought Montgomery, Alabama was a lot closer to Jackson, Mississippi than it actually is.

We were up late the night before in Tuscaloosa preparing the last Alabama turn-in (Chuck Baldwin, because Barr and Nader were already done) and Jake could not find some of his signatures (he found them later in the car, after the deadline). Also, Jake had some Barr signatures he collected volunteer after they had enough and stopped paying for them, and wanted to give them to the LP, so we agree to meet Rster down in Montgomery.

Andy and Christie were in Auburn and went to meet us in Montgomery also, but they got a few on campus and there were delays, while we got a few at Alabama State U., then tried to rendezvous with both the LP and CP guys at the state house in Montgomery as well as with Andy and Christie….by the time everyone got it together it was well past noon.

At that point I discovered on the GPS that Jackson was a lot further than I remembered it being (I should have checked) and there was no way in hell we would get there in time.

This is when I talked to Brian Moore on the phone and we came up with the cabbie idea.

Lesson number one million to not do things at the last minute.
