WASHINGTON — Justice David H. Souter has indicated that he plans to retire at the end of the term in June, giving President Obama his first appointment to the Supreme Court, three people informed about the decision said Thursday night…

A spokeswoman for the court said Thursday night that Justice Souter, 69, “has no comment on these reports that he is planning to resign.”

Souter supported debate inclusion for government-sponsored debates in the 1998 case Arkansas Educational TV Commission v Forbes, and he supported fusion in the 1997 case Timmons v Twin Cities Area New Party. But, in his separate dissent in Timmons, he said that the argument that the “two-party system” needs to be protected is a strong argument…

    I guess this is not “third party or independent news” in the strictest sense. But, darned it will affect us all a lot!

    I suppose I could also say in as much as the Supreme Court is the ultimate decider on all our ballot access cases, it will make a big difference in the territory…

    Neither did Barack Obama ever show much concern for third party concerns. Richard Winger and Chicago newspapers have both shone light on how Obama made an unblocked run into the Illinois state Senate by challenging the petitions of every Democratic candidate until he was running unopposed. No doubt he will not stress the importance of multiple choices on a ballot to his Supreme Court nominee.

    Barack Obama did show some third party support, since he was a member of the New Party.

    Good to see this post with Richard Winger’s comments. Souter was also one of the anti-property rights justices in the infamous Kelo v. New London case.
